An Act to amend the Tobacco Act. [ 12th June, 2026
ENACTED by the Parliament of Zambia. 1. (1) This Act may be cited as the Tobacco (Amendment)
Act, 2026, and shall be read as one with the Tobacco Act, 2022, in
this Act referred to as the principal Act. (2) This Act shall come into operation on the expiry of the
term of office, or removal by the Minister, of the members of the
Board holding office prior to the enactment of this Act, after which
the Minister shall appoint the members of the Board in accordance
with this Act. 2. Section 5 of the principal Act is amended by the deletion of
subsections (1) and (2) and the substitution therefor of the following:
(1) There is constituted the Board of the
Tobacco Board of Zambia which consists of the
following part-time members appointed by the
Minister:
(a) a representative each of the ministries
responsible for—
(i) agriculture;
(ii) commerce; and
(iii) finance;
(b) a representative of the Attorney-
General;

(c) a representative of an association
representing small scale tobacco
growers;
(d) a representative of an association
representing large scale tobacco
growers;
(e) a representative of an association
representing buyers; and
(f) two persons from the private sector with
knowledge and experience in matters
relevant to this Act.
(2) The ministries, institutions and
organisations referred to in subsection (1) shall
nominate their representatives for appointment by the
Minister.
