An Act to amend the Sports Council of Zambia Act. [ 12th June, 2026 ENACTED by the Parliament of Zambia. 1. (1) This Act may be cited as the Sports Council of Zambia (Amendment) Act, 2026, and shall be read as one with the Sports Council of Zambia Act, in this Act referred to as the principal Act. (2) This Act shall come into operation on the expiry of the term of office, or removal by the Minister, of the members of the Board holding office prior to the enactment of this Act, after which the Minister shall appoint the members of the Board in accordance with this Act. 2. Section 2 of the principal Act is amended by the insertion of the following new definition in the appropriate place in alphabetical order: “Emoluments Commission” means the Emoluments Commission established by the Constitution;. 3. Section 13 of the principal Act is amended by the insertion of the following new subsection immediately after subsection (3): (4) The Emoluments Commission shall, on the recommendation of the Minister, determine the allowances of a member of a committee of the Council. The principal Act is amended by the repeal of section 16 and the substitution therefor of the following: 16. (1) There is constituted an Executive Board of the Council which consists of the following part- time members appointed by the Minister: (a) a representative each of the ministries responsible for— (i) sports, youth and arts; (ii) local government; (iii) health; and (iv) education; (b) a representative of the Attorney-General; and (c) four representatives of associations registered under the Act. (2) The Director shall be an ex-officio member of the Board and shall have no vote at any meeting of the Board. (3) The ministries, institutions and organisations referred to in subsection (1) shall nominate their representatives for appointment by the Minister. (4) The Minister shall appoint a Chairperson of the Board from among the members specified under subsection (1)(c). (5) The members of the Board shall elect the Vice-Chairperson from among themselves. (6) A member of the Board shall be paid allowances that the Emoluments Commission may, on the recommendation of the Minister, determine. (1) Subject to the other provisions of this Act, the Board shall provide strategic policy direction to the Council. Sports Council of Zambia (Amendment)714 No. 57 of 2026] Repeal and replacement of section 16 Composition of Board Insertion of section 16A Functions of Board Council of Zambia (Amendment)714 No. 57 of 2026] Repeal and replacement of section 16 Composition of Board Insertion of section 16A Functions of Board (2) Despite the generality of subsection (1), the functions of the Board are to— (a) approve policies, programmes and strategies of the Council; (b) approve the annual budget estimates and financial statements of the Council; (c) approve the annual work plan, action plans and activity reports of the Council; (d) monitor and evaluate the performance of the Council against budgets and plans; and (e) promote effective corporate governance of the Council. (3) The Board may, by direction, in writing, and on conditions that the Board considers necessary, delegate to the Director any of the Board’s functions under this Act. (4) A delegation made in accordance with subsection (3) shall not prevent the Board from performing the function so delegated. (5) The Minister may give to the Board general or specific directions relating to the performance of the Board’s functions and the Board shall give effect to those directions to the extent that they are not inconsistent with this Act or any other written law. 6. The principal Act is amended by the repeal of section 18 and the substitution therefor of the following: 18. ith this Act or any other written law. 6. (1) The Council shall appoint a Secretary for the Council who shall be— (a) the chief executive officer of the Council; and (b) responsible for the day-to-day administration of the Council under the direction of the Council. (3) The Emoluments Commission shall, on the recommendation of the Council, determine the emoluments of the Secretary, agents and other staff of the Council. (4) The Council shall determine the terms and conditions of service, other than emoluments, of the Secretary, agents and other staff of the Council. 7. Section 21 of the principal Act is amended by the— (a) deletion of paragraph (b); and (b) renumbering of paragraph (c) as paragraph (b). 8. The principal Act is amended by the deletion of the word “Chairman” wherever the word appears and the substitution therefor of the word “Chairperson”.
