The Penal Code (Amendment) Act, 2026

An Act to amend the Penal Code Act.
[ 12th June, 2026
ENACTED by the Parliament of Zambia.
1. This Act may be cited as the Penal Code (Amendment)
Act, 2026, and shall be read as one with the Penal Code Act, in this
Act referred to as the principal Act.
2. Section 282B of the principal Act is amended by the—
(a) deletion of subsection (3) and the substitution therefor of
the following:
(3) A person who is convicted of an offence
under subsection (1)(b) is liable—
(a) in the case of a first offence, to
imprisonment for a term of not less than
seven years; and
(b) in the case of a second or subsequent
offence, to imprisonment for a term of
not less than ten years.; and
(b) insertion of the following new subsection immediately after
subsection (4):

(5) A Court may, in addition to the penalties
imposed under this section, order the restitution of
stock or produce stolen in accordance with sections
179 and 180 of the Criminal Procedure Code Act.Cap. 88
