Enactment Short title and commen- cement Cap. 152 Amendment of section 2 Cap. 1 Cap. 305 [No. 65 of 2026 749 National Institute of Public Administration (Amendment) An act to amend the National Institute of Public Administration Act. [12th June, 2026 ENACTED by the Parliament of Zambia. 1. (1) This Act may be cited as the National Institute of Public Administration (Amendment) Act, 2026, and shall be read as one with the National Institute of Public Administration Act, in this Act referred to as the principal Act. (2) This Act shall come into operation on the expiry of the term of office, or removal by the Minister, of the members of the Council holding office prior to the enactment of this Act, after which the Minister shall appoint the members of the Council in accordance with this Act. 2. Section 2 of the principal Act is amended by the insertion of the following new definitions in the appropriate places in alphabetical order: “Emoluments Commission” means the Emoluments Commission established under the Constitution; “legally disqualified” means the absence of legal capacity as provided in section 4 of the Mental Health Act; GOVERNMENT OF ZAMBIA ACT No. nstitution; “legally disqualified” means the absence of legal capacity as provided in section 4 of the Mental Health Act; GOVERNMENT OF ZAMBIA ACT No. 65 of 2026 Date of Assent: 4th June,2026 Single copies of this Act may be obtained from the Government Printer, P.O. Box 30136, 10101 Lusaka, Price K8.00 each. “Zambia Institute of Chartered Accountants” means the Zambia Institute of Chartered Accountants established under the Accountants Act; and “Zambia Institute of Human Resource Management” means the Zambia Institute of Human Resource Management established under the Zambia Institute of Human Resource Management Act, 2022. 3. Management” means the Zambia Institute of Human Resource Management established under the Zambia Institute of Human Resource Management Act, 2022. 3. Section 5 of the principal Act is amended by the— (a) deletion of subsection (1) and the substitution therefor of the following: (1) There is constituted the governing Council of the Institute which consists of the following part- time members appointed by the Minister: (a) a representative of the ministry responsible for labour; (b) a representative of the Attorney-General; (c) a representative of the Public Service Management Division, Cabinet Office; (d) a representative of the Zambia Institute of Chartered Accountants; (e) a representative of the Zambia Institute of Human Resource Management; (f)a representative of the Zambia Institute of Management; (g) two representatives of federations of trade unions; and (h) one person from the private sector with knowledge and experience in business and commercial regulation.; (b) insertion of the following new subsections immediately after subsection (2): (3) The ministries, institutions and organisations referred to in subsection (1) shall nominate their representatives for appointment by the Minister. No. 3 of 2022 Amendment of section 5 750 No. 65 of 2026] National Institute of Public Administration (Amendment) (4) A person shall not be appointed as a member of the Council if that person is— (a) an undischarged bankrupt; (b) legally disqualified from performing the functions of a member; or (c) convicted of an offence under this Act or any other law and sentenced to a term of imprisonment exceeding six months without an option of a fine.; and (c) renumbering of subsection (3) as subsection (5). 4. The principal Act is amended by the repeal of section 7 and the substitution therefor of the following: 7. A member of the Council or committee of the Council shall be paid allowances that the Emoluments Commission may, on the recommendation of the Minister, determine. 5. Section 10 of the principal Act is amended by the deletion of subsection (4).
