The National Arts Council of Zambia Act, 2026

An Act to amend the National Arts Council of Zambia Act. [ 12th June, 2026
ENACTED by the Parliament of Zambia. 1. (1) This Act may be cited as the National Arts Council of
Zambia (Amendment) Act, 2026, and shall be read as one with the
National Arts Council of Zambia Act, in this Act referred to as the
principal Act. (2) This Act shall come into operation on the expiry of the term
of office, or removal by the Minister, of the members of the Council
holding office prior to the enactment of this Act, after which the
Minister shall appoint the members of the Council in accordance
with this Act. 2. Section 2 of the principal Act is amended by the insertion of
the following new definitions in the appropriate places in alphabetical
order:
“Law Association of Zambia” means the Law Association of
Zambia established under the Law Association of Zambia
Act; and
“legally disqualified” means the absence of legal capacity as

3. The Schedule to the principal Act is amended—
(a) by the deletion of paragraph 2 and the substitution therefor
of the following:
2. (1) The Council consists of the following
part-time members appointed by the Minister:
(a) a representative each from the ministries
responsible for—
(i) tourism;
(ii) commerce;
(iii) education; and
(iv) arts;
(b) a representative of the Attorney-General;
(c) a representative of the Law Association of Zambia;
(d) three representatives of the most representative
associations engaged in matters relevant to the
arts and creative industry; and
(e) two persons from the private sector with
knowledge and experience in investment,
resource mobilisation or strategic partnership
development for the arts and creative industry. (2) The ministries, institutions and
organisations referred to in subsection (1) shall
nominate their representatives for appointment by the
Minister. (3) The Chairperson and the Vice-
Chairperson shall be elected by members of the
Council from amongst themselves, subject to
ratification by the Minister.

(4) A person shall not be appointed as a
member of the Council if that person is—
(a) an undischarged bankrupt;
(b) legally disqualified from performing the functions
of a member; or

(c) convicted of an offence under this Act or any other
law and sentenced to a term of imprisonment
exceeding six months without an option of a
fine.;and
(b) in paragraph 5, by the deletion of subparagraph (3) and
the substitution therefor of the following:
(3) Seven members shall form a quorum at a
meeting of the Council.
