[No. 21 of 2026 609Higher Education (Amendent) An Act to amend the Higher Educatoin Act. [ 12th June, 2026 ENACTED by the Parliament of Zambia. 1. (1) This Act may be cited as the Higher Education (Amendment) Act, 2026, and shall be read as one with the Higher Education Act, in this Act referred to as the principal Act. (2) This Act shall come into operation on the expiry of the term of office, or removal by the Minister, of the members of the Board holding office prior to the enactment of this Act, after which the Minister shall appoint the members of the Board in accordance with this Act. 2. Section 2 of the principal Act is amended by the insertion of the following new definitions in the appropriate places in alphabetical order: “Emoluments Commission” means the Emoluments Commission established under the Constitution; “Examinations Council of Zambia” means the Examinations Council of Zambia established under the Examinations Council of Zambia Act, 2023; Enactment Short title and commen- cement Cap. 1 Cap. 136 Amendment of section 2 Act No. 3 of 2023 Single copies of this Act may be obtained from the Government Printer, P.O. nd commen- cement Cap. 1 Cap. 136 Amendment of section 2 Act No. 3 of 2023 Single copies of this Act may be obtained from the Government Printer, P.O. Box 30136, 10101, Lusaka, Price K8.00 each GOVERNMENT OF ZAMBIA ACT No. 21 of 2026 Date of Assent: 4th June, 2026 Box 30136, 10101, Lusaka, Price K8.00 each GOVERNMENT OF ZAMBIA ACT No. 21 of 2026 Date of Assent: 4th June, 2026 610 No. 21 of 2026] “Technical Education, Vocational and Entrepreneurship Training Authority” means the Technical Education, Vocational and Entrepreneurship Training Authority established under the Technical Education, Vocational and Entrepreneurship Training Act; “Zambia Institute of Chartered Accountants” means the Zambia Institute of Chartered Accountants established under the Accountants Act; and “Zambia Institute of Human Resource Management” means the Zambia Institute of Human Resource Management established under the Zambia Institute of Human Resource Management Act, 2022. 3. Management” means the Zambia Institute of Human Resource Management established under the Zambia Institute of Human Resource Management Act, 2022. 3. Section 7 of the principal Act is amended by the deletion of— (a) subsection (1) and the substitution therefor of the following: (1) There is constituted the Board of the Authority which consists of the following part-time members appointed by the Minister: (a) a representative of the ministry responsible for higher education; (b) a representative of the Attorney- General; (c) a representative of the Zambia Institute of Chartered Accountants; (d) a representative of the Examinations Council of Zambia; (e) a representative of the Zambia Institute of Human Resource Management; (f) a representative of the Technical Education, Vocational and Entrepreneurship Training Authority; (g) a representative of the Zambia Chamber of Commerce and Industry; (h) a representative of a civil society organisation working in the education sector; and Amendment of section 7 Cap.138 Cap. 390 Act No. 3 of 2022 Higher Education (Amendent) civil society organisation working in the education sector; and Amendment of section 7 Cap.138 Cap. 390 Act No. 3 of 2022 Higher Education (Amendent) [No. 21 of 2026 611 (i) one person from the private sector with knowledge and experience in matters relating to higher education.; and (b) subsection (5) and the substitution therefor of the following: (5) The ministries, institutions and organisations referred to in subsection (1) shall nominate their representatives for appointment by the Minister. 4. The First Schedule to the principal Act is amended— (a) in paragraph 1(4), by the deletion of the word “Six” and the substitution therefor of the word “Five”; and (b) by the deletion of paragraph 3 and the substitution therefor of the following: 3.
