A BILL ENTITLED An Act to amend the Health Professions Act, 2009. [20th May, 2021 ENACTED by the Parliament of Zambia. 1. This Act may be cited as the Health Professions (Amendment) Act, 2021, and shall be read as one with the Health Professions Act, 2009, in this Act referred to as the principal Act. 2. Section 2 of the principal Act is amended by the insertion of the following new definitions in the appropriate places in alphabetical order: “Higher Education Authority” means the Higher Education Authority established under the Higher Education Act, 2013; and “Zambia Qualifications Authority” means the Zambia Qualifications Authority established under the Zambia Qualifications Authority Act, 2011. 3. Section 8 of the principal Act is amended by the deletion of subsection (7) and the substitution therefor of the following: (7) The Minister may, by statutory instrument, on the recommendation of the Council, prescribe the scope of practice for health practitioners registered under this Act. Section 12 of the principal Act is amended by the deletion of subsection (2) and substitution therefor of the following: (2) The Registrar shall register a health practitioner as a specialist if the health practitioner holds a post graduate qualification accredited and recognised by the Zambia Qualifications Authority. (3) For the purposes of this section, a post-graduate qualification shall include a fellowship programme as recognised by the Council. 5. Section 32 of the principal Act is amended by the deletion of subsection (1) and the substitution therefor of the following: (1) A higher education institution shall not advertise, provide or hold out as providing training to prepare students for a health profession, unless the training programme is accredited by the Higher Education Authority. 6. The principal Act is amended by the repeal of section 33 and the substitution therefor of the following: 33. (1) A higher education institution that intends to offer training in a health profession shall apply to the Higher Education Authority for accreditation of the training programme. ution that intends to offer training in a health profession shall apply to the Higher Education Authority for accreditation of the training programme. (2) The Higher Education Authority shall, in consultation with the Council, accredit the training programme if the training programme meets the requirements for service in the health profession. (3) The Council shall not, where a training institution uses a training programme in the training of health profession which is not accredited under this section, accept the training for the purposes of registration in the health profession. 7. Section 51 of the principal Act is amended by the deletion of the subsection (3) and the substitution thereof of the following: (3) The Minister may, be statutory instrument, on the recommendation of the Council, prescribe the category of a health practitioner and professional experience required of a registered health practitioner who is to supervise the operations of a health facility of a particular licence class. 8. Section 77(2)(f) of the principal Act is amended by the insertion of the words “accredited and recognised by the Zambia QualificationsAuthority” immediately after the word “qualification”. is amended by the insertion of the words “accredited and recognised by the Zambia QualificationsAuthority” immediately after the word “qualification”.
