An Act to amend the Biosafety Act. [12th June, 2026 ENACTED by the Parliament of Zambia. 1. (1) This Act may be cited as the Biosafety (Amendment) Act, 2026, and shall be read as one with the Biosafety Act, in this Act referred to as the principal Act. (2) This Act shall come into operation on the expiry of the term of office, or removal by the Minister, of the members of the Board holding office prior to the enactment of this Act, after which the Minister shall appoint the members of the Board in accordance with this Act. 2. Section 2 of the principal Act is amended by the insertion of the following new definition in the appropriate place: “legally disqualified” means the absence of legal capacity as provided in section 4 of the Mental Health Act. 3. The First Schedule to the principal Act is amended in— (a) paragraph 1, by the deletion of subparagraphs (1) and (2) and the substitution therefor of the following: (1) The Authority consists of the following part-time members appointed by the Minister: Enactment Biosafety (Amendment) [No. 49 of 2026 691 Cap.151 Amendment of section 2 Cap. 305 Amendment of First Schedule Short title and commen- cement GOVERNMENT OF ZAMBIA ACT No. t) [No. 49 of 2026 691 Cap.151 Amendment of section 2 Cap. 305 Amendment of First Schedule Short title and commen- cement GOVERNMENT OF ZAMBIA ACT No. 49 of 2026 Date of Assent: 4th June, 2026 Single copies of this Act may be obtained from the Government Printer, P.O. Box 30136, 10101, Lusaka, Price K4.00 each (a) the Chairperson, who shall be a person with knowledge and experience in matters relevant to this Act; (b) a representative each from the ministries responsible for— (i) environment; and (ii) agriculture; (c) a representative of the Attorney-General; (d) a representative of an organisation representing farmers; (e) a representative of the Zambia Chamber of Commerce and Industry; (f) a representative of the Zambia Consumer Association; (g) a representative of a civil society organisation engaged in agro-economy and biodiversity; and (h) three representatives from non-governmental organisations engaged in matters relevant to this Act. (2) The ministries, institutions and organisations referred to in subsection (1) shall nominate their representatives for appointment by the Minister.; and (b) paragraph 4(4), by the deletion of the word “five” and the substitution of the word “seven”.
