1. These Rules may be cited as the Registration of Persons Rules. (L.N. 29/1981, r. 2.) 2. (1) Where a notice under section 6 of the Act requiring a person to attend before a registration officer at such place and between such dates as may he specified is not brought to the notice of that person by publication in the Gazette, the notice shall be served personally on that person by delivery or tender of the notice to him. (2) Every person on whom a notice is so served shall, if required by the person serving it, sign a receipt therefor on the back of a duplicate of the notice. 3. (1) The identity card issued under section 9 of the Act shall consist of a polycarbonate electronic card set out in the First Schedule in Form A or a card sealed in a plastic envelope set out in the First Schedule in Form B or Form C. (4) The expiry date in the polycarbonate electronic card relates to the electronic functionality of the card. (1) Every person applying for registration shall whenever possible do so at his place of domicile or at his place of permanent residence. 4, r. 2.) 4. (2) Where a person attends before a registration officer for the purpose of having himself registered under section 6(2) of the Act, the registration officer shall— (a) demand proof of his date of birth or apparent age by production of the birth certificate or age assessment certificate issued by a Government medical officer of health or a baptismal certificate issued by a minister of a recognized religious organization immediately following his birth or some other evidence acceptable to the Principal Registrar; (b) demand proof of his Kenyan citizenship; and (c) record in the physical or electronic form set out in the second schedule, the particulars of that person specified in section 5(1) of the Act and shall forward the particulars physically or electronically when completed to the Principal Registrar. (1) Where a person attends before a registration officer for the purpose of registering himself or herself under section 6(1) or (2) of the Act, that person shall permit the registration officer to record— (a) his or her facial, thumb and fingerprint biometric data in a prescribed electronic or digital device; (b) thumb and fingerprint impressions in the Form set out in the Third Schedule of these Rules; (c) the parent or guardian shall permit the registration officer to record their thumb print on the Second Schedule in physical or electronic format; and (d) the identifying administrative officer shall permit the registration officer to record their thumb print on the Second Schedule. (2) The registration officer shall thereupon fill in and sign a physical or digitally generated certificate in the form set out in the Fourth Schedule and shall issue the certificate to that person. The Principal Registrar shall adopt the unique personal identification number issued under the Births and Deaths Registration Act (Cap. 149), or may allot such index letters and serial numbers as the Principal Registrar may deem fit to be inserted in the identity cards as the identity number (L.N. 154/2024, r. 5.) 8. (1) Upon the loss of an identity card, the registered person shall be required to report the loss to the nearest police station and obtain an abstract report or to an administrative office and obtain an official letter certifying the loss. (3) Upon collection of the new identity card the registered person shall surrender the certificate issued to him under subrule (2) to the registration officer. (4) Upon the issue of the certificate to the person and until the issue to him of a new identity card, the certificate shall not be deemed for all purposes to be an identity card issued under the Act. (5) There shall be inserted in every new identity card the particulars which are contained in the register in respect of the person to whom the new identity card is being issued. (5A) Where the registered person is making an application to renew or replace a mutilated identity card, the person shall be required to surrender their current identity card upon collection of the new identity card. (6) Persons to whom a new identity card is issued under section 9(1) or 9(3) shall pay to the authorized officer a fee prescribed in the sixth schedule. (1) Where a registered person changes his or her name or place of permanent residence, the person shall unless they can be readily located through their previous address without undue delay, attend before a registration officer, give to the registrar the particulars of the change in the Form in the Fifth Schedule and permit the person left thumb impression to be taken on that form or in an electronic device. (2) Where the change of name is as a result of marriage or divorce, the marriage certificate or decree of divorce shall be produced in such form as may be prescribed by the Marriage Act (Cap. 150). (3) The particulars given under paragraphs (1) and (2) shall be complete in all respects and shall be such as will enable the Principal Registrar readily to communicate with the registered person. (6) The registration officer shall without delay forward the completed application in physical or electronic form to the principal registrar who shall record the changes in the register, cancel the surrendered identity card and issue a new identity card in accordance with the new particulars. A registration officer may refuse to change the names of a registered person where the registered person requests the change in the names appearing on his identity card to include thereon the names of a deceased person. (1) Any registered person who ceases to be a citizen of Kenya shall, within twenty-four hours, surrender his identity card to the nearest immigration officer or police station or registration office or chief‘s office or send it by registered post to the Principal Registrar. (2) The officer to whom an identity card has been surrendered in accordance with this rule, other than the Principal Registrar, shall, as soon as possible, deliver it to the nearest registration office or send it by registered post to the Principal Registrar. (3) Before issuing a death certificate, under the Births and Deaths Registration Act (Cap. 149), a registrar of births and deaths shall recover the identity card of the deceased and deliver it to the District Registrar or send it by registered post to the Principal Registrar who shall amend the register accordingly. (1) The Principal Registrar may issue a certificate of appointment to any registration officer appointed under section 4(2) of the Act in a form approved by the Cabinet Secretary. (2) A registration officer who has been issued with a certificate of appointment shall, when on duty, keep it on his person. (3) It shall be lawful for any person or authority to demand to see the certificate of appointment of any person who may be exercising the powers conferred upon registration officers under section 17 of the Act. (2) Despite subrule (1), the fees prescribed in the Sixth Schedule in respect of— (a) Duplicate/Replacement; and (b) Change of Particulars, shall be nil for the period commencing on the 30th April, 2026 and ending on the 30th October, 2026.
