THE GUARANTEE (HIGH COMMISSION RAILWAYS AND HARBOURS LOANS) (SUPPLEMENTARY PROVISIONS) ORDINANCE* k/ Short title. det 4 Ins_ Commencement : 8th March, 1955 An Ordinance to provide for matters supplemental to the provisions of the Guarantee (High Commission Railways and Harbours Loans) (No. 2) Ordinance Fl ( 1. This -Oidirtattee may be cited as the Guarantee (High Commission Railways and Harbours Loans) (Supplementary Provisions) Ordinance. Pr ,2. In this w "the Act of 1951" means the Loan (Railways and Harbours) (1951) Act of the High Commission; Interpretation. Cap. 14 (1951). 7 of 1952. "the Act of 1952" means the Loan (Railways and Harbours) Act, 1952, of the High Commission; "approved instrument" means any instrument which has been approved by resolution of the Legislative Council whether before or after the commencement of this Ordinance and includes any instrument required to be executed by any such instrument as aforesaid; "High Commission (Railways and Harbours Loans) securities" has the meaning assigned to that expression by the Cap. 456. such instrument as aforesaid; "High Commission (Railways and Harbours Loans) securities" has the meaning assigned to that expression by the Cap. 456. Guarantee (High Commission Railways and Harbours Loans) (No. 2) Ordinance. * By virtue of the East African Common Services Organization (Adaptation of Laws) (No. 2) Order, 1962 (L.N. 153/1962 and L.N. 176 /1962)— (a) the references in thisOrd nail—I-a—to securities of the High Commission (meaning thereby the loan securities of the High Commission) are to be read and construed as if they also included references to the loan securities of the Authority; and subject thereto 1)! (b) the references in this Ordunanci e to the High Commission are, in respect of any time or period commencing on or after the 8th December, 1961, to be read and construed as if they were references to the Authority. in respect of any time or period commencing on or after the 8th December, 1961, to be read and construed as if they were references to the Authority. Guarantee (High Commission Railways and Harbours Rev. 1962] Loans) (Supplementary Provisions) CAP. 457 3 Power of Governor to execute binding instruments. 3. (1) The Governor is hereby empowered to execute any approved instrument relating directly or indirectly to any loan authorized to be raised by the High Commission under the authority of the Act of 1951 or the Act of 1952 or relating to the purposes for which any such loan is so authorized to be raised. (2) Any approved instrument executed by the Governor in pursuance of this section shall be valid and binding in all respects upon the Government and every other party thereto, and to the extent to which any moneys are required to meet the obligations of the Government under any such approved instrument they shall constitute a charge on the general revenues and funds of Kenya.
