BE it enacted by the Governor of the East, Africa Protectorate with the advice and consent of the Legislative Council thereof 1. This Ordinance may be cited as " The Equitable Mortgages Ordinance I909." 2. Subject to the provisions hereinafter contained nothing in Section 39 of the Indian Transfer of Property Act 1882 ( Act 1V of 1882 ) as applied to the East Africa Protectorate shall he deemed to render invalid Mortgages made in the East Africa Protectorate by delivery to a creditor or his agent of a document or documents of Title to immovable property, with intent to create a security thereon.
